Is it legal to fly with cannabis? Marijuana legalization is becoming more popular. While federal legalization in the United States appears to be on the horizon in 2022, the regulations surrounding cannabis are currently complex and confusing.
In New York City, for example, it is allowed to use cannabis on public streets. However, in some places, such as Denver, Colorado, it is illegal to do so (or any other recreationally legal city in the U.S.) It is permitted to carry up to 2 ounces of marijuana in several counties. Others have a legal limit of less than one ounce.
The rules for bringing cannabis on a plane are equally perplexing. Are you passing across legal states? Was your medicinal cannabis obtained from a reputable medical source? Is it in your checked luggage or carry-on? Do you plan to fly out of Oakland or Anchorage?
Amnesty boxes have been placed up for travelers at Chicago’s O’Hare International Airport. “The boxes are where travelers may safely dispose of cannabis and cannabis products before travel,” Maggie Huynh, public relations coordinator for the Chicago Police Department, told The Washington Post.
“TSA’s screening methods are focused on security and are meant to detect possible risks to aviation and passengers,” according to the TSA website. As a result, TSA security employees do not look for marijuana or other illegal substances during security screening, but if any unlawful substance is discovered, TSA will refer the situation to a law enforcement official.”
If a police officer is dispatched, they must follow local laws (remember, the local laws in 18 states say cannabis is recreationally legal.)
Vape pens are another potentially dangerous item. Vape pens are legal to bring in carry-on luggage. However, cannabis and non-cannabis vape pens appear to be the same. It’s another gray area in the travel sector, with no clear lines formed between the two.
Transporting CBD products with less than.03 percent THC is permitted. According to the TSA website, any other FDA-approved cannabis/hemp products are also allowed. Hemp bags and apparel are OK.
Even while traveling internationally, medical cannabis may be more accepted. A few people have successfully and legally transported medical cannabis to nations like New Zealand.
In legal states, it is uncertain whether carrying cannabis on a plane is lawful. So, should you bring cannabis with you on your trip? Perhaps, but perhaps not. With so many unknowns, you can’t be sure you’ll arrive at your goal unscathed, or at least with your belongings. But it’s really interesting to watch the rules change as cannabis becomes legal over the world.
